2. Register of Personal and Real Rights

I. Maintained or Updated Rights

Right to Object (Article 21 GDPR)
Principle: Users may object to the use of their personal data if they have a legitimate reason.
Exception: MyCVFactory may refuse the objection if it has a legitimate overriding interest.

Right to Rectification (Article 16 GDPR)
In case of incorrect data, users have the right to request its correction as soon as possible.
Examples: incorrect age, date of birth, academic background, etc.

MyCVFactory may request supporting documents to verify the requester’s identity.

Right to Digital Legacy (Article 40.II, French Data Protection Law)
Any person may define general or specific instructions regarding the handling of their data after death.
MyCVFactory commits to deleting all relevant data (email, CV, communication, etc.) once informed of the death, and will transfer the data to the person designated by the user prior to deletion.

II. New Rights

Right to Restrict Processing (Articles 18 and 4.3 GDPR)

Principle: Users may request temporary suspension of data processing in specific cases.

Exception: Processing may resume with the user’s consent.

MyCVFactory has one month (extendable for complex requests) to respond. During this period, the content is removed from the platform. Users are informed of the restriction implementation.

Right to Object to Profiling (Article 13 GDPR)
Principle: Users may object to automatic profiling that has legal or significant personal effects.

Exception: Objection is valid only for reasons related to the user’s personal situation. It may be rejected in three cases: contract necessity, legal obligation, or explicit consent.

MyCVFactory informs users that they may object to profiling and will stop using their data if objection is raised.

Right to Data Portability (Article 20 GDPR)
Users may retrieve their data and transfer it to a third party.
Limitations: This applies only to data provided directly by the user, processed automatically, and based on prior consent.
An ID may be requested. In case of refusal, MyCVFactory will issue a written and justified response.

Right to Erasure (Article 17 GDPR)
Principle: Users may request the deletion or dereferencing of their data.

Applies in the following six cases:

  • Withdrawal of consent
  • Data no longer necessary
  • Exercising right to object
  • Unlawful processing
  • Data collected from minors without parental consent
  • Legal obligation to delete
